Applicability of AADHAR to NRI/PIOs

 

  • As per Section 3(1) of Aadhaar Act 2016,"every resident shall be entitled to obtain an Aadhaar number by submitting his demographic information and biometric information by undergoing the process of enrollment.

 

  • Further Section 2(v) of the Aadhaar Act 2016 defines 'Resident' as an individual who has resided in India for a period of 182 days or more in the last 12 months immediately preceding the date of application for enrolment.

 

  • Prevention of money laundering Act 2017 and section 139AA of the Income tax Act 1961 stipulates that the linking of Bank Accounts and PAN respectively is for those persons who are eligible to enroll for Aadhaar as per the Aadhaar Act 2016.

 

  • Therefore, it is suggested to consider the following while deciding applicability of Aadhaar to NRIs/PIOs:
  • Aadhaar as an identity document may be sought only from those who are eligible for it as per the Aadhaar Act, 2016.
  • And many  NRIs/PIOs/OCIs may not be eligible for Aadhaar enrolment as per the Aadhaar Act, 20l6
